MANJUNG: A gold shop in Ayer Tawar here was raided by enforcement officers from the Ministry of Domestic Trade and Cost of Living (KPDN) for allegedly misusing a registered trademark under the guise of genuine gold branding.
The operation, conducted under Ops Jenama last Wednesday, involved KPDN enforcement officers from the Manjung branch alongside trademark representatives, with the total value of seized jewellery amounting to RM8,908.
According to the Director of KPDN Perak, Datuk Kamalludin Ismail, some jewellery items bearing well-known genuine gold trademarks were displayed for sale at the premises.
“Among the seized jewellery were earrings, rings, and pendants that carried trademarks wrongly used under the well-known genuine gold branding.
“As such, the case will be investigated under the Trademarks Act for suspected offences under Section 102(1)(c) of the Trademarks Act 2019.
“This involves possession, custody, or control of goods for the purpose of trade or manufacturing, bearing falsely applied trademarks,” he said in a statement here today.
He also issued a warning to individuals or companies involved to always comply with the established legal requirements.
“Anyone found committing such offences may be prosecuted under Section 100(4)(a)(i)/(ii) of the Trademarks Act 2019.
“If convicted, companies may be fined up to RM15,000, while individuals may face fines not exceeding RM10,000 or imprisonment for up to three years, or both,” he added.
